What is the Unified Patent Court?

The Unified Patent Court (UPC) is a specialised European patent court that rules on infringement and invalidity issues relating to

  • unitary patents and
  • classic European patents (unless excluded by opt-out).

The UPC is organised with central chambers in Munich and Paris and local chambers in various European countries, and is staffed by highly specialised judges with extensive experience in patent litigation. Decisions so far show that proceedings before the UPC are conducted swiftly and that decisions are legally and economically balanced.

The unitary patent

The unitary patent is an independent instrument of the European patent system and provides patent protection in several European countries, including Germany, France, Italy and Austria. It raises its own strategic, economic and legal questions – particularly with regard to costs, risk profile and company size.
